Terms of Service
Introductory provisions
These Terms of Service (the "Terms") govern your access to and use of Verse Surf, including the companion website https://vsurf.live/, the game client and all related services (together, the "platform and Game"). The platform and Game is provided by SHOPSOFT SRL (hereinafter "Verse Surf", “we” or “us”).
By accessing or using the platform and Game, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. In case you do not agree to these Terms, you will be requested to exit, and to not access our platform and Game and/or use our services.

Definitions
In this section we explain what terms will be used, inter alia, within the document:
- Host – means the person who runs the game client and creates a Room, for example on a TV, computer or console.
- Player – means any person who joins a Room, usually from a phone or browser, by entering a Room Code and a Nickname.
- Room – means a game session created by a Host, identified by a temporary Room Code.
- User Content – means any content submitted by a Player or Host through the platform and Game, including nicknames, answers, votes, likes and custom playlists.
- Virtual Items – means any VIP status, perks (such as selecting or editing custom playlists), or other digital content or features made available through in-app purchases.
Eligibility
You may use the platform and Game only if you are old enough to consent to the processing of your personal data in your country of residence, or if you have the permission of a parent or legal guardian. A parent or legal guardian who allows a minor to use the platform and Game is responsible for the minor’s use of it and for their acceptance of these Terms.
The Game
Verse Surf is a multiplayer party game in which Players listen to songs, make up lyrics, try to guess the correct ones and vote on each other’s answers. To join a game, you only need the Room Code displayed by the Host and a Nickname of your choice; no account is required to play as a Player.
We grant you a personal, limited, non-exclusive, non-transferable and revocable license to access and use the platform and Game for your own non-commercial entertainment, subject to these Terms. All rights not expressly granted to you are reserved by us and our licensors.
Songs, lyrics, album art and other music-related content shown in the platform and Game are the property of their respective owners and are used for the purpose of the Game only. You may not record, download, extract or redistribute such content.
Hosts access the Game through third-party platforms such as Steam, XBOX, Android TV and others. Your use of these platforms is also subject to their own terms of service, and we kindly recommend that you review them.
Code of Conduct
Verse Surf is meant to be fun for everyone in the Room. When using the platform and Game, you agree not to:
- choose nicknames or submit answers that are hateful, harassing, threatening, sexually explicit, defamatory, or that infringe on the rights of others;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- join Rooms you were not invited to, or disrupt games played by others;
- use cheats, bots, scripts, automation or any unauthorized third-party software to interact with the platform and Game;
- attempt to reverse engineer, decompile, overload, probe or interfere with our servers, networks or security measures;
- use the platform and Game for any commercial purpose or in violation of any applicable law.
Hosts are able to remove Players from their Room. We may also, at our sole discretion and without prior notice, remove Players, close Rooms, or restrict access to the platform and Game for anyone who breaches these Terms.
User Content
You are solely responsible for the User Content you submit. User Content is displayed to the other participants in the Room and may be shown on the Host’s screen, which may be visible to people who are not playing (for example, on a stream or in a public place).
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display and reproduce it for the purpose of operating, providing and improving the platform and Game. Most User Content is temporary and is discarded once the game session ends, as described in our Privacy Policy.
Purchases and Virtual Items
Certain features, such as VIP status and its perks, may be offered for purchase. Purchases are processed by third-party payment providers and platforms (such as Steam), and are subject to their terms and refund policies. We do not collect or store your payment data.
Virtual Items are licensed to you, not sold, and have no monetary value outside the platform and Game. They cannot be exchanged for cash or transferred to other users. Except where required by applicable law, or by the policies of the platform through which the purchase was made, all purchases are final and non-refundable.
If you are a consumer residing in the European Union, you acknowledge that by requesting immediate access to digital content you lose your right of withdrawal once the delivery of the digital content has begun.
Availability of the Service
The platform and Game requires an active internet connection. We strive to keep it available at all times, but we do not guarantee that it will be uninterrupted, timely or error-free. Rooms, games and playlists may be interrupted, reset or removed, for example during maintenance or updates. We may modify, suspend or discontinue any part of the platform and Game at any time.
Intellectual Property
The platform and Game, including its software, design, characters, artwork, text, graphics, logos and the Verse Surf name, is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws. Nothing in these Terms transfers any of these rights to you.
Third-party Services
The platform and Game relies on and may link to third-party services, including Unity ®, Steam, XBOX, Android TV and music metadata providers. We are not responsible for the content, policies or practices of any third-party services. Unity’s terms can be found following this link: https://unity.com/legal.
Disclaimer of Warranties
The platform and Game is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the platform and Game. Our total liability for any claim related to the platform and Game will not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory rights as a consumer.
Termination
You may stop using the platform and Game at any time. We may suspend or terminate your access to the platform and Game if you breach these Terms or if we are required to do so by law. The provisions of these Terms which by their nature should survive termination will remain in effect.
Governing Law
These Terms are governed by the laws of Romania, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms will be submitted to the competent courts of Iasi, Romania, without prejudice to any mandatory rights you may have as a consumer under the laws of your country of residence.

Amendments
We may update these Terms of Service from time to time by publishing the updated version (or the updated section) on our platform and Game. Your continued use of the platform and Game after an update means you accept the updated Terms. We kindly request you to check this page occasionally, in order to ensure you agree with any changes and updates.
